CMC Limited Warranty:

  • CMC will warrant all parts for a period of one year, from the date of installation, to be free of material defects that occur as the result of normal use.
  • CMC will warrant all labor for a period of 90 days, from the date of service, to be free of workmanship defects that occur as the result of normal use.
  • CMC will repair or replace any part, which CMC determines is defective. Any labor charges associated with the installation or removal of the defective part will not be reimbursed unless the work is done by CMC. If work is done outside of CMC the part will default to the manufacturer's warranty. The part must be returned to CMC within 30 days of failure. The defective part will become the property of CMC, and the new part will be warranted from the installation date of the original part. All qualifying warranty parts and/or labor will only be honored at CMC locations.
  • This limited warranty is exclusive and in lieu of all other warranties whether written, oral or implied including, but not limited to, any warranty of merchantability or fitness for purpose. This limited warranty is void, and CMC shall not be obligated to repair or replace any component or part, where the necessity of such replacement or repair, in CMC's opinion, is due in whole or in part to loads in excess of factory rated capacity, improper maintenance or service, modification or alteration, accident, or other misuse or abuse of the component or part.
  • The component or part must be maintained and serviced as prescribed from time to time in written CMC maintenance instructions, if any. In the absence of written CMC maintenance instructions, the manufacturer's instructions must be followed.

Limitation On Liability:

  • Limitation on Liability CMC will not be liable for consequential or incidental damages, including but not limited to, personal injury, property damage, or loss of vehicle use and profits.

Items Excluded From Warranty:

  • This warranty will not apply to: * Antifreeze, chemical additives, fire extinguishers, fluids, tires, and tire chains.
  • Parts that have been damaged by exposure to the elements or chemicals such as road salts or industrial fallout.
  • Parts damaged from abuse, misuse, neglect, alteration or accident, or which have been improperly lubricated, repaired, or installed, or used in any manner other than they were designed for.
  • Used parts.
  • Progressive damage.
  • Parts not purchased from CMC.
  • Freight and critical charges.
  • Labor charges to remove or replace defective parts sold but not installed by CMC.
  • Glass breakage or scratches unless there is proof of faulty installation or manufacturing.
  • Towing charges.
  • Additional exclusions are: Parts that are subject to wear during their normal service life and are routinely replaced during periodical service are not covered under warranty, unless, it is shown that they failed as a result of a manufacturing defect. Items excluded, but not limited to: Belts, Brake linings, Wiper blades, Mud flaps, Fuses, Filters (fuel, air, oil, and water), Clutch linings, Data logger batteries, Fluorescent ballast and tubes, Light bulbs and non-reusable sealed light assemblies, Receiver-dryer filter/suction accumulator, Tires.
  • This Parts Warranty Policy is effective as of January 1, 2006 and applies to parts that CMC installs on or after such date. CMC reserves the right at any time to amend, suspend, or terminate its Parts Warranty Policy. Any such amendment, suspension, or termination shall apply only to parts that CMC installs on or after the date of such amendment, suspension, or termination.
